L&#8217;UE sta lavorando a <a href="https://ec.europa.eu/commission/presscorner/detail/en/ip_25_1820">un&#8217;app di verifica dell&#8217;et&#224;</a> che collegher&#224; direttamente l&#8217;ID elettronico alle attivit&#224; online dei cittadini. Il <a href="https://www.techradar.com/computing/cyber-security/after-the-uk-online-age-verification-is-landing-in-the-eu">prototipo</a> &#232; gi&#224; in fase di test in Italia, Danimarca, Spagna e Grecia. Parallelamente, si sta sviluppando un <a href="https://web.archive.org/web/20250214112039/https://commission.europa.eu/strategy-and-policy/priorities-2019-2024/europe-fit-digital-age/european-digital-identity_de">portafoglio digitale</a> che in futuro conterr&#224; la patente di guida, i dati sanitari e le carte bancarie.</p><p>Anche la Germania sta promuovendo l&#8217;identit&#224; elettronica: il <a href="https://web.archive.org/web/20250414132558/https://www.wiwo.de/downloads/30290756/7/koalitionsvertrag-2025.pdf">contratto di coalizione del governo guidato da CDU e SPD</a> prevede un conto civico obbligatorio e un&#8217;identit&#224; elettronica che sar&#224; collegata al portafoglio digitale dell&#8217;UE. Nel Regno Unito, l&#8217;identit&#224; elettronica &#232; gi&#224; oggi un requisito indispensabile per lavoro, alloggio e assistenza sanitaria. L&#8217;Australia si spinge ancora oltre: in futuro, l&#8217;accesso ai motori di ricerca come Google o Bing sar&#224; possibile solo con l&#8217;identit&#224; elettronica. In Svezia, sebbene sia ufficialmente facoltativa, nella vita quotidiana &#232; praticamente <a href="https://www.youtube.com/watch?v=6ZgAxr9ikkk&amp;t=113s">indispensabile</a> &#8211; che si tratti di operazioni bancarie, dichiarazioni dei redditi o prestazioni sanitarie. L&#8217;Austria, invece, punta sulla pressione: chi rifiuta l&#8217;&#171;<a href="https://www.id-austria.gv.at/de/verwenden/app-id-austria">ID Austria</a>&#187; statale rischia sanzioni. Di recente, un&#8217;insegnante <a href="https://www.derstandard.at/story/3000000279827/lehrerin-weigerte-sich-id-austria-zu-verwenden-und-wurde-gekuendigt-was-steckt-dahinter">ha perso il posto di lavoro</a> perch&#233; si &#232; rifiutata di utilizzare l&#8217;identit&#224; digitale.</p><p>Anche in Svizzera la politica spinge per un&#8217;identit&#224; elettronica &#8211; frenata unicamente dalla democrazia diretta. Nel 2021 gli elettori hanno respinto la proposta di allora con un netto 64,4 percento. Invece di accettare questa decisione, il Consiglio federale ha rapidamente presentato una nuova proposta: nel nuovo disegno di legge, il certificato d&#8217;identit&#224; digitale non sar&#224; pi&#249; emesso da aziende private, ma dallo Stato. Fortunatamente, anche questa legge sar&#224; sottoposta al voto popolare. Il 28 settembre si decider&#224; se i cittadini respingeranno nuovamente l&#8217;identit&#224; elettronica &#8211; o se questa volta si lasceranno convincere dalle promesse del Consiglio federale e dei suoi sostenitori.</p><h2><strong>Tutt&#8217;altro che statale</strong></h2><p>Ufficialmente il Consiglio federale giustifica il suo nuovo tentativo con l&#8217;argomento che la prima proposta sarebbe fallita a causa <a href="https://x.com/barbouillech/status/1878881144013500489">dell&#8217;opposizione agli emittenti privati</a>. Tuttavia, uno sguardo all&#8217;analisi VOX della <a href="https://vox.gfsbern.ch/wp-content/uploads/2021/04/d_vox_schlussbericht_def.pdf">votazione</a> del 2021 mostra che a risultare decisivi furono le preoccupazioni sulla protezione dei dati e sul ruolo dello Stato. La questione se l&#8217;E-ID dovesse essere emessa da privati o dallo Stato ebbe solo un ruolo secondario. Il Consiglio federale costruisce quindi un pretesto per rimettere in carreggiata il progetto.</p><p>Dal 1977 l&#8217;istituto di ricerca di mercato <em>gfs.bern</em> realizza con la sua <a href="https://vox.gfsbern.ch/de/">analisi VOX</a> interviste agli aventi diritto di voto dopo le votazioni popolari, per scoprire per quali motivi abbiano votato a favore o contro una proposta di legge. L&#8217;analisi sulla votazione della legge E-ID del 2021 mostra che tra i motivi del campo del No, la protezione dei dati e il ruolo dello Stato ebbero un peso centrale. Il tema degli emittenti privati dell&#8217;E-ID ebbe invece solo un&#8217;importanza marginale. Le preoccupazioni riguardavano quindi in generale la protezione dei dati &#8212; non principalmente se l&#8217;E-ID dovesse essere emessa da aziende private o dallo Stato. &#200; dunque evidente che il Consiglio federale cercasse solo un pretesto per rilanciare la legge sull&#8217;E-ID.</p><p>Ma persino l&#8217;affermazione secondo cui la nuova E-ID sarebbe interamente statale non regge a un esame attento. L&#8217;Ufficio federale di polizia (<em>fedpol</em>) dipende infatti da partner privati. <a href="https://www.eid.admin.ch/de/elca-gewinnt-die-ausschreibung-zur-online-verifikation-der-antragsstellenden-im-e-id-ausstellungsprozess-d">Ha affidato</a> la verifica online dei richiedenti all&#8217;azienda informatica losannese ELCA Informatique SA. Inoltre, l&#8217;app Bundeswallet &#8212; il portafoglio digitale in cui viene memorizzata l&#8217;identit&#224; &#8212; pu&#242; essere scaricata esclusivamente <a href="https://www.digitale-gesellschaft.ch/event/netzpolitischer-abend-zu-stand-der-entwicklung-der-staatlichen-e-id/">da Google Play e dall&#8217;Apple App Store</a>. I cittadini svizzeri risultano quindi nuovamente dipendenti dalle Big Tech. Ma gi&#224; un breve sguardo ai fatti solleva dubbi. L&#8217;Ufficio federale di polizia (<em>fedpol</em>) &#232; responsabile della memorizzazione e della gestione dei dati. Che proprio questa autorit&#224; debba guadagnarsi la fiducia dei cittadini appare discutibile. Solo di recente il <em>fedpol</em> &#232; finito sui titoli dei giornali a causa di un <a href="https://www.watson.ch/schweiz/digital/419698936-hackerangriff-daten-von-fedpol-im-darknet-veroeffentlicht">attacco hacker</a>: dati sensibili sono poi comparsi nel darknet.</p><p>Anche il processo di emissione, regolato <a href="https://www.fedlex.admin.ch/eli/fga/2025/20/it#art_17">dall&#8217;art. 17</a> della legge, &#232; problematico dal punto di vista della protezione dei dati. Chi richiede un&#8217;E-ID deve presentare un video del proprio volto &#8211; la cosiddetta &#171;procedura di identificazione video&#187;. In questo processo, il documento d&#8217;identit&#224; mostrato viene confrontato con la persona nel video e verificato per autenticit&#224;. Ma la tecnologia ha un punto debole: i video deepfake sono ormai ampiamente diffusi. Con le foto che circolano in rete, che praticamente chiunque condivide sui social media, si possono creare falsificazioni incredibilmente realistiche. L&#236;, il Chaos Computer Club &#232; riuscito ad accedere a <a href="https://www.ccc.de/de/updates/2022/chaos-computer-club-hackt-video-ident">migliaia di cartelle cliniche elettroniche</a> attraverso studi medici mal protetti e tessere sanitarie manipolate. Perch&#233; la Svizzera dovrebbe essere immune da scenari simili?</p><p>Che la Confederazione stessa non escluda il pericolo lo dimostra un passaggio della legge. Secondo <a href="https://www.fedlex.admin.ch/eli/fga/2025/20/it#art_27">l&#8217;art. 27,</a> i dati vengono conservati per vent&#8217;anni, mentre i dati biometrici vengono cancellati solo cinque anni dopo la scadenza dell&#8217;E-ID. Questo lungo periodo porta a un&#8217;unica conclusione: la Confederazione si aspetta furti d&#8217;identit&#224; e vuole permettere la tracciabilit&#224; in caso di emergenza. Indirettamente, ammette cos&#236; che qualcuno potrebbe utilizzare un&#8217;E-ID con falsa identit&#224; per anni.</p><h2><strong>Volontariet&#224; ingannevole</strong></h2><p>I sostenitori sottolineano sempre la volontariet&#224; dell&#8217;E-ID. Ma uno sguardo attento alla legge mostra che di vera volontariet&#224; non si pu&#242; parlare.</p><p><a href="https://www.fedlex.admin.ch/eli/fga/2025/20/it#art_24">L&#8217;art. 24</a> obbliga tutte le autorit&#224; e gli enti con compiti pubblici ad accettare l&#8217;E-ID. <a href="https://www.fedlex.admin.ch/eli/fga/2025/20/it#art_25">L&#8217;art. 25</a> prevede s&#236; che debba essere accettato anche un passaporto secondo <a href="https://www.fedlex.admin.ch/eli/fga/2025/20/it#art_14">l&#8217;art. 14</a> &#8211; ma solo se la persona &#171;si presenta personalmente&#187;. Questo sembra offrire una scelta, ma nella pratica &#232; un&#8217;illusione. Per i servizi online come Instagram, Netflix o l&#8217;e-commerce nessuno pu&#242; &#171;presentarsi personalmente&#187;. Quindi, di fatto, rimane solo l&#8217;E-ID. La conseguenza: per quasi tutte le attivit&#224; digitali l&#8217;E-ID diventa obbligatoria. Esempi da Austria, Svezia o <a href="https://www.nzz.ch/international/e-id-in-estland-ohne-digitale-identitaet-bist-du-niemand-ld.1755983">Estonia</a> mostrano quanto rapidamente un&#8217;identit&#224; digitale passi da offerta apparentemente volontaria a obbligo di fatto. Chi non la utilizza riesce a malapena a svolgere le attivit&#224; fondamentali della vita quotidiana.</p><p>Anche in Svizzera l&#8217;E-ID diventer&#224; un requisito per servizi essenziali. Ordinare un estratto del casellario giudiziale per posta non sar&#224; pi&#249; possibile &#8211; solo con l&#8217;E-ID o presentandosi personalmente allo sportello. Il registro dei donatori di organi sar&#224; in futuro accessibile esclusivamente tramite l&#8217;E-ID, cos&#236; come la cartella clinica elettronica, che diventer&#224; lo standard. Tutte queste sono forme di coercizione indiretta che minano la presunta volontariet&#224;.</p><p>In aggiunta, <a href="https://www.fedlex.admin.ch/eli/fga/2025/20/it#art_31">l&#8217;art. 31</a> permette ai cantoni di imporre tasse aggiuntive se i cittadini usufruiscono di servizi di persona anzich&#233; digitalmente con l&#8217;E-ID. Chi non vuole l&#8217;E-ID deve quindi pagare di pi&#249;. Solo dopo un periodo che pu&#242; durare fino a due anni deve chiedere l&#8217;approvazione del Parlamento. Se questa non viene concessa, la normativa decade &#8211; ma in questo lasso di tempo il Consiglio federale potrebbe gi&#224; aver creato fatti compiuti. In altre parole: per due anni potrebbe introdurre nell&#8217;E-ID, tramite ordinanza, nuovi campi di dati sensibili senza coinvolgere n&#233; il popolo n&#233; il Parlamento. L&#8217;esperienza dimostra che il Consiglio federale utilizza regolarmente questi margini di manovra per introdurre nuove disposizioni. Un esempio evidente sarebbe un passaporto sanitario digitale tramite l&#8217;E-ID, che potrebbe essere richiesto su larga scala in caso di crisi. Ci&#242; significa che potrebbe firmare accordi internazionali sull&#8217;E-ID senza alcuna partecipazione del popolo o del Parlamento. Ufficialmente, questo dovrebbe facilitare l&#8217;utilizzo e il riconoscimento legale dell&#8217;E-ID svizzera all&#8217;estero &#8211; cos&#236; come il riconoscimento delle E-ID straniere in Svizzera. Ma la proposta concede al Consiglio federale anche il diritto di emanare unilateralmente tutte le disposizioni per l&#8217;attuazione di tali trattati. Al pi&#249; tardi, quando l&#8217;UE avr&#224; completamente stabilito il proprio sistema di E-ID, il Consiglio federale potrebbe recepire direttamente le direttive di Bruxelles in Svizzera &#8211; senza che i cittadini aventi diritto di voto possano mai esprimersi in merito.</p><h2><strong>Mancanza di trasparenza</strong></h2><p>Il Consiglio federale e i sostenitori assicurano che l&#8217;E-ID sia trasparente. Ma questo non corrisponde al vero. Una vera trasparenza presupporrebbe che il codice sorgente del software fosse reso pubblico. Proprio questo, per&#242;, &#232; escluso dalla legge sull&#8217;E-ID: secondo <a href="https://www.fedlex.admin.ch/eli/fga/2025/20/it#art_12">l&#8217;art. 12</a>, il codice sorgente pu&#242; rimanere segreto per motivi di protezione dei diritti di terzi o di sicurezza. Non si pu&#242; quindi parlare di open source.</p><p>L&#8217;art. 12, comma 1, obbliga s&#236; l&#8217;UFIT a divulgare il codice sorgente dell&#8217;infrastruttura fiduciaria. A prima vista, questo sembra un atto di trasparenza. Ma il comma 2 riduce drasticamente questo obbligo: il codice sorgente o parti di esso non vengono pubblicati quando &#171;diritti di terzi o motivi rilevanti di sicurezza lo escludono o lo limitano&#187;. Nella bozza originale si menzionavano solo i motivi di sicurezza &#8211; il Parlamento ha aggiunto la clausola sui &#171;diritti di terzi&#187;.</p><p>Questo offre ai fornitori privati che consegnano software alla Confederazione una facile scappatoia: invocando i diritti di licenza, possono negare l&#8217;accesso. Il pubblico non viene cos&#236; a sapere quali programmi operano in background e come vengono trattati i dati. Un vero controllo diventa quindi impossibile. Chi costruisce un sistema con dati tanto sensibili dovrebbe invece garantire che il pubblico possa comprendere esattamente come funziona la tecnologia.</p><p>La Confederazione si affida invece alla &#171;<a href="https://de.wikipedia.org/wiki/Security_through_obscurity">Security by Obscurity</a>&#187; &#8211; cio&#232; al tentativo di ottenere sicurezza mantenendo segrete le modalit&#224; di funzionamento. Gli esperti criticano questo approccio da anni. Il National Institute for Standards and Technology <a href="https://en.wikipedia.org/wiki/Security_through_obscurity">statunitense</a> lo sconsiglia espressamente.</p><h2><strong>Sorveglianza totale</strong></h2><p>Con l&#8217;E-ID, lo Stato ottiene uno strumento per monitorare i cittadini in ogni loro passo. I documenti d&#8217;identit&#224; fisici lasciano a malapena tracce digitali: vengono richiesti raramente e i dati di solito non vengono memorizzati. Con l&#8217;E-ID &#232; diverso. Ogni utilizzo del documento elettronico genera dati personali che vengono archiviati. Questo fornisce allo Stato uno strumento di sorveglianza che supera di gran lunga le possibilit&#224; di controllo dei sistemi totalitari del XX secolo &#8211; e rappresenta una seria minaccia per i diritti fondamentali in Svizzera.</p><p>I sostenitori promettono che non verranno creati profili utente e che tutto rimarr&#224; anonimo. Ma gi&#224; <a href="https://www.fedlex.admin.ch/eli/fga/2025/20/it#art_12">l&#8217;art. 10, comma 3</a>, rivela il punto debole: l&#8217;Ufficio federale dell&#8217;informatica e delle telecomunicazioni (UFIT) non avr&#224; accesso al contenuto dei certificati &#8211; tranne che in base ai dati generati dalle richieste. Con ogni richiesta, con ogni login, l&#8217;UFIT raccoglie metadati: indirizzi IP, timestamp, numeri di porta e altro. Si crea cos&#236; un pacchetto completo di informazioni che viene archiviato centralmente.</p><p><a href="https://www.fedlex.admin.ch/eli/fga/2025/20/it#art_2">Gli articoli 2 e 3</a> della legge disciplinano i registri presso l&#8217;UFIT. Anche qui si afferma che non &#232; prevista un&#8217;attribuzione diretta alle persone. Ma di nuovo ci sono eccezioni: i dati personali raccolti durante l&#8217;interrogazione del registro di base possono infatti essere valutati nominalmente &#8211; come consente <a href="https://www.fedlex.admin.ch/eli/cc/1997/2022_2022_2022/it#art_57_o">l&#8217;art. 57, comma 1, lett. A e B</a> della Legge sull&#8217;organizzazione del governo e dell&#8217;amministrazione (LOGA), ad esempio in caso di &#171;concreto sospetto di abuso&#187; o per la &#171;difesa da minacce&#187;.</p><p>Basta quindi un semplice sospetto per esaminare i dati di accesso. Tramite indirizzi IP e timestamp si possono identificare dispositivi, sistemi operativi e abitudini di utilizzo. Lo Stato potrebbe creare un profilo dettagliato: quando, quanto spesso e a quali orari una persona effettua l&#8217;accesso. A ci&#242; si aggiungono possibili richieste ai provider, che possono rivelare persino i domini visitati o i dati geolocalizzati delle celle telefoniche.</p><p>Rimane dunque solo un confine sottilissimo tra l&#8217;uso presumibilmente anonimo e la tracciabilit&#224; effettiva. Anche al minimo sospetto, l&#8217;identit&#224; pu&#242; essere rivelata. Ma i servizi pubblici sono sempre finanziati dai contribuenti &#8211; e quindi non possono mai essere davvero gratuiti. Il progetto svizzero dell&#8217;E-ID, inoltre, &#232; tutt&#8217;altro che economico: tra il 2023 e il 2028 sono previsti circa <a href="https://www.admin.ch/dam/gov/de/Dokumentation/Abstimmungen/September2025/Bar_Erlaeuterungen_September_2025_de_v2.pdf.download.pdf/Bar_Erlaeuterungen_September_2025_de_v2.pdf">180 milioni di franchi</a> per lo sviluppo e la gestione dell&#8217;infrastruttura. Dal 2029 si aggiungeranno circa <a href="https://www.srf.ch/news/schweiz/abstimmung-vom-28-september-beat-jans-wirbt-fuer-e-id">25 milioni di franchi</a> all&#8217;anno di costi di esercizio. Queste somme esorbitanti saranno alla fine sostenute da tutti i contribuenti &#8211; anche da chi non intende utilizzare l&#8217;E-ID.</p><h2><strong>Non c&#8217;&#232; bisogno di un&#8217;E-ID</strong></h2><p>Sorge spontanea una domanda: a cosa serve davvero un documento d&#8217;identit&#224; digitale? La Confederazione indica due motivi. Primo: l&#8217;E-ID dovrebbe essere necessaria per le <a href="https://www.fedlex.admin.ch/eli/fga/2023/2842/it">pratiche amministrative</a>. Ma per questo esiste gi&#224; un <a href="https://www.agov.admin.ch/it">login ufficiale per le autorit&#224;</a> &#8211; un&#8217;E-ID aggiuntiva &#232; superflua. Secondo: dovrebbe servire per la verifica dell&#8217;et&#224; nella vita quotidiana, ad esempio al supermercato o in edicola. Ma anche qui la carta d&#8217;identit&#224; fisica &#232; pi&#249; che sufficiente. Anzi, &#232; la soluzione migliore, perch&#233; non lascia tracce digitali e tutela in modo pi&#249; efficace la privacy. In breve: i documenti d&#8217;identit&#224; tradizionali sono nettamente superiori all&#8217;E-ID, sia in termini di sicurezza che di protezione dei dati.</p><h2><strong>Campagna referendaria nella fase finale</strong></h2><p>La campagna per la votazione &#232; entrata nella fase finale. Ho cercato di illustrare in dettaglio perch&#233; la legge svizzera sull&#8217;E-ID sia pericolosa, superflua e quindi da respingere. Avrei potuto menzionare altri punti, ma ci&#242; avrebbe superato i limiti.</p><p>Il movimento per i diritti civili <em>MASS-VOLL!</em>, di cui faccio parte, ha lanciato il referendum a gennaio e, con le firme raccolte, ha contribuito in modo decisivo affinch&#233; il popolo svizzero possa votare su questa proposta il 28 settembre. The EU is working on an <a href="https://ec.europa.eu/commission/presscorner/detail/en/ip_25_1820">age verification app</a> designed to link the E-ID directly to citizens&#8217; online activities. The <a href="https://www.techradar.com/computing/cyber-security/after-the-uk-online-age-verification-is-landing-in-the-eu">prototype</a> is already being tested in Italy, Denmark, Spain, and Greece. At the same time, a <a href="https://web.archive.org/web/20250214112039/https://commission.europa.eu/strategy-and-policy/priorities-2019-2024/europe-fit-digital-age/european-digital-identity_de">digital wallet</a> is being developed that will eventually store driving licenses, health data, and bank cards.</p><p>Germany is also pushing ahead with electronic identity: the coalition agreement of the CDU-SPD government mandates a compulsory citizen account and an E-ID linked to the EU wallet. In the United Kingdom, electronic identity is already a prerequisite for employment, housing, and healthcare. Australia goes even further: access to internet search engines like Google or Bing will soon only be possible with an E-ID. In Sweden, while officially voluntary, it has become practically <a href="https://www.youtube.com/watch?v=6ZgAxr9ikkk&amp;t=113s">indispensable</a> in daily life &#8211; whether for banking, tax returns, or doctor visits. Austria, meanwhile, applies pressure: those who refuse the state <a href="https://www.id-austria.gv.at/de/verwenden/app-id-austria">ID Austria</a> can face sanctions. A teacher recently <a href="https://www.derstandard.at/story/3000000279827/lehrerin-weigerte-sich-id-austria-zu-verwenden-und-wurde-gekuendigt-was-steckt-dahinter">lost</a> her job because she refused to use the digital identity.</p><p>In Switzerland too, politicians are pushing for an E-ID &#8211; restrained only by direct democracy. In 2021, voters rejected the previous <a href="https://de.wikipedia.org/wiki/Eidgen%C3%B6ssische_Volksabstimmung_%C3%BCber_das_E-ID-Gesetz">proposal</a> by a decisive 64.4 percent. Instead of accepting this decision, the Federal Council quickly presented a new draft: under this bill, the digital proof of identity would supposedly be issued by the state rather than private companies. Fortunately, this law will also be put to a popular vote. On September 28, voters will decide whether to reject the E-ID again &#8211; or whether this time they will be convinced by the promises of the Federal Council and its supporters.</p><h2><strong>Anything but state-run</strong></h2><p>Officially, the Federal Council justifies its new attempt by arguing that the first proposal failed due to <a href="https://x.com/barbouillech/status/1878881144013500489">resistance against private issuers</a>. A glance at the VOX analysis of that <a href="https://vox.gfsbern.ch/wp-content/uploads/2021/04/d_vox_schlussbericht_def.pdf">referendum</a> is enough to see that completely different factors played a role. Since 1977, the market research institute <em>gfs.bern</em> has used its <a href="https://vox.gfsbern.ch/de/">VOX analysis</a> to survey voters after referendums and determine why they voted for or against a legislative proposal. The analysis of the 2021 E-ID vote shows that data protection and the role of the state were the decisive concerns of the No camp. The role of private issuers was secondary. The debate was therefore generally about data protection &#8211; not primarily about whether private companies or the state should issue the E-ID. It becomes clear that the Federal Council was merely looking for a pretext to relaunch the law.</p><p>Even the claim that the new E-ID is purely state-run does not stand up to scrutiny. The Federal Office of Police (<em>fedpol</em>) relies on private partners. It <a href="https://www.eid.admin.ch/de/elca-gewinnt-die-ausschreibung-zur-online-verifikation-der-antragsstellenden-im-e-id-ausstellungsprozess-d">awarded</a> the online verification of applicants to the Lausanne IT company ELCA Informatique SA. In addition, the Federal Wallet app &#8211; the digital wallet in which the identity is stored &#8211; can only be downloaded via <a href="https://www.digitale-gesellschaft.ch/event/netzpolitischer-abend-zu-stand-der-entwicklung-der-staatlichen-e-id/">Google Play and the Apple App Store</a>. Swiss citizens are thus once again dependent on Big Tech. But even a brief look at the facts raises doubts. The Federal Office of Police is responsible for storing and managing the data. That this particular authority should inspire citizens&#8217; trust seems questionable. Only recently, fedpol made headlines after a <a href="https://www.watson.ch/schweiz/digital/419698936-hackerangriff-daten-von-fedpol-im-darknet-veroeffentlicht">hacker attack</a>: sensitive data subsequently appeared on the darknet.</p><p>The issuance process, regulated in <a href="https://www.fedlex.admin.ch/eli/fga/2025/20/de#art_17">Art. 17</a> of the law, is also problematic from a data protection perspective. Anyone applying for an E-ID must submit a facial video &#8211; the so-called video identification procedure. The presented ID document is compared with the person in the video and checked for authenticity. But the technology has a weakness: deep-fake videos are now widespread. With photos circulating online, which practically everyone shares on social media, deceptively authentic forgeries can be created. There, the Chaos Computer Club managed to <a href="https://www.ccc.de/de/updates/2022/chaos-computer-club-hackt-video-ident">gain access to thousands of electronic patient records</a> through poorly secured medical practices and manipulated health cards. Why should Switzerland be immune to similar scenarios? That the federal government itself does not rule out the danger is evident from the law. According to <a href="https://www.fedlex.admin.ch/eli/fga/2025/20/de#art_27">Art. 27</a>, data must be stored for twenty years, with biometric data only deleted five years after the E-ID expires. This long retention period allows only one conclusion: the federal government anticipates identity theft and wants to ensure traceability in case of emergency. Indirectly, it thus admits that someone could use an E-ID under a false identity for years.</p><h2><strong>Deceptive Voluntariness</strong></h2><p>Supporters constantly emphasize the voluntary nature of the E-ID. But a closer look at the law shows: there is no such thing as true voluntariness. <a href="https://www.fedlex.admin.ch/eli/fga/2025/20/de#art_24">Art. 24</a> obliges all authorities and bodies with public duties to accept the E-ID. <a href="https://www.fedlex.admin.ch/eli/fga/2025/20/de#art_25">Art. 25</a> does stipulate that a passport under <a href="https://www.fedlex.admin.ch/eli/fga/2025/20/de#art_14">Art. 14</a> must also be accepted &#8211; but only if the person &#171;appears in person&#187;. This may sound like a choice, but in practice it&#8217;s a sleight of hand. For online services like Instagram, Netflix, or e-commerce, nobody can &#171;appear in person&#187;. That leaves the E-ID as the only option. The result: for almost all digital activities, the E-ID becomes mandatory. Examples from Austria, Sweden, and <a href="https://www.nzz.ch/international/e-id-in-estland-ohne-digitale-identitaet-bist-du-niemand-ld.1755983">Estonia</a> show how quickly a digital identity shifts from a supposedly voluntary offer to a de facto requirement. Those who don&#8217;t use it can hardly manage even basic everyday tasks.</p><p>In Switzerland too, the E-ID will become a prerequisite for essential services. Ordering a criminal record extract by mail will no longer be possible &#8211; only with an E-ID or by appearing at the counter. The organ donor registry will in future be accessible exclusively via the E-ID, as will the electronic patient record, which will thus become the standard. All of these are forms of indirect coercion that undermine the claim of voluntariness.</p><p>What&#8217;s more: <a href="https://www.fedlex.admin.ch/eli/fga/2025/20/de#art_31">Art. 31</a> allows cantons to charge additional fees if citizens access services in person rather than digitally with the E-ID. In other words: anyone who refuses the E-ID will have to pay extra. Only after up to two years must it seek Parliament&#8217;s approval. If approval is denied, the regulation lapses &#8211; but by then, the Federal Council could already have created facts on the ground. In other words: for two years it could add new, sensitive data fields to the E-ID by decree, without involving either the people or Parliament. Experience shows that the Federal Council often uses such latitude to introduce new regulations. A likely example would be a digital health pass via the E-ID, widely required in times of crisis. This represents a massive delegation of powers that undermines democratic rights.</p><div id="youtube2-f2Dej8JHAU8" class="youtube-wrap" data-attrs="{&quot;videoId&quot;:&quot;f2Dej8JHAU8&quot;,&quot;startTime&quot;:null,&quot;endTime&quot;:null}" data-component-name="Youtube2ToDOM"><div class="youtube-inner"><iframe src="https://www.youtube-nocookie.com/embed/f2Dej8JHAU8?rel=0&amp;autoplay=0&amp;showinfo=0&amp;enablejsapi=0" frameborder="0" loading="lazy" gesture="media" allow="autoplay; fullscreen" allowautoplay="true" allowfullscreen="true" width="728" height="409"></iframe></div></div><p><a href="https://www.fedlex.admin.ch/eli/fga/2025/20/de#art_32">Art. 32</a> goes even further: it authorizes the Federal Council to &#171;independently conclude international treaties&#187;. This means it could sign agreements on the E-ID without any input from the people or Parliament. Officially, this is intended to facilitate the use and legal recognition of the Swiss E-ID abroad &#8211; as well as the recognition of foreign E-IDs in Switzerland. But the proposal also grants the Federal Council the power to unilaterally enact all provisions needed to implement such treaties. Once the EU fully establishes its own E-ID system, the Federal Council could directly adopt Brussels&#8217; requirements into Swiss law &#8211; without voters ever having a say.</p><h2><strong>Lack of Transparency</strong></h2><p>The Federal Council and its supporters claim that the E-ID is transparent. In reality, it is not. Genuine transparency would require the disclosure of the software&#8217;s source code. But this is precisely what the E-ID law rules out: according to <a href="https://www.fedlex.admin.ch/eli/fga/2025/20/de#art_12">Art. 12</a>, the source code may remain secret for reasons of third-party rights protection or security. Open source, therefore, is out of the question.</p><p><a href="https://www.fedlex.admin.ch/eli/fga/2025/20/de#art_12">Art. 12, Para. 1</a> does oblige the Federal Office for Information Technology and Telecommunications (BIT) to disclose the source code of the trust infrastructure. At first glance, this sounds like transparency. But Para. 2 severely limits this obligation: the source code, or parts of it, will not be published if &#171;third-party rights or security-related reasons would exclude or restrict this&#187;. The original draft only mentioned security reasons &#8211; Parliament later added the clause about &#171;third-party rights&#187;.</p><p>This gives private providers supplying software to the federal government a convenient loophole: by invoking license rights, they can deny access. As a result, the public cannot know which programs run in the background or how data is processed. Real oversight thus becomes impossible. Anyone building a system that processes such sensitive data should instead guarantee that the public can fully understand how the technology works.</p><p>Instead, the federal government relies on <a href="https://de.wikipedia.org/wiki/Security_through_obscurity">Security by Obscurity</a> &#8211; the attempt to achieve security by keeping the inner workings secret. Experts have criticized this approach for years. The US National Institute for Standards and Technology <a href="https://en.wikipedia.org/wiki/Security_through_obscurity">explicitly advises against it</a>.</p><div><hr></div><h2><strong>Total Surveillance</strong></h2><p>With the E-ID, the state gains an instrument to monitor its citizens at every turn. Physical IDs leave hardly any digital traces: they are rarely required and the data is generally not stored. With the E-ID, it's different. Each presentation of the electronic ID generates personal data that is stored. This provides the state with a surveillance tool that far surpasses the control capabilities of totalitarian systems of the 20th century &#8211; and poses a significant threat to fundamental rights in Switzerland.</p><p>Supporters promise that no user profiles will be created and everything will remain anonymous. But <a href="https://www.fedlex.admin.ch/eli/fga/2025/20/de#art_10">Art. 10 Para. 3</a> already shows the weakness: While the FOITT does not have access to the contents of the credentials &#8211; except based on the data generated by queries. With each query, with each login, metadata accumulates at the FOITT: IP addresses, timestamps, port numbers, and more. This creates a comprehensive data package that is centrally stored. <a href="https://www.fedlex.admin.ch/eli/fga/2025/20/de#art_2">Articles 2 and 3</a> of the law regulate the registers at the FOITT. There too, it states that direct attribution to individuals is not intended. But again, there are exceptions: Personal data collected when querying the basic register may indeed be evaluated by name &#8211; permitted by <a href="https://www.fedlex.admin.ch/eli/cc/1997/2022_2022_2022/de#art_57_o">Art. 57o Para. 1 lit. a and b of the Government and Administration Organisation Act (GAOA)</a>, for instance in cases of &#171;concrete suspicion of misuse&#187; or to &#171;counter concrete threats&#187;. A mere suspicion is therefore sufficient to scrutinize login data. Through IP addresses and timestamps, devices, operating systems, and usage habits can be identified. The state could create a detailed profile from this: when, how often, and at what times a person logs in. Additionally, there are possible provider queries that could even reveal visited domains or geodata from mobile phone towers. This leaves only a paper-thin boundary between supposedly anonymous use and actual traceability. Even with the slightest suspicion, identity can be disclosed. The potential for abuse of power is thus built into the law &#8211; and all experience shows: whatever powers the state receives, it will use.</p><h2><strong>There is no such thing as a free lunch</strong></h2><p>Another myth from the Yes camp is that the state E-ID is free. But state services are always funded by taxpayers &#8211; and therefore can never truly be free. Regardless, the Swiss E-ID project is anything but cheap: between 2023 and 2028, around <a href="https://www.admin.ch/dam/gov/de/Dokumentation/Abstimmungen/September2025/Bar_Erlaeuterungen_September_2025_de_v2.pdf.download.pdf/Bar_Erlaeuterungen_September_2025_de_v2.pdf">180 million francs</a> are earmarked for developing and operating the infrastructure. From 2029 onwards, about <a href="https://www.20min.ch/story/trotz-kritik-elektronische-id-auf-der-zielgeraden-das-musst-du-wissen-103227530">25 million francs</a> in ongoing costs will be added each year. These enormous sums will ultimately be borne by all taxpayers &#8211; including those who do not want to use the E-ID at all.</p><h2><strong>A Digital Identity is Not Needed</strong></h2><p>The question arises: why do we need a digital proof of identity at all? The federal government cites two reasons. First, the E-ID is supposedly required for <a href="https://www.fedlex.admin.ch/eli/fga/2023/2842/de">government transactions</a>. But an <a href="https://www.agov.admin.ch/de">official government login</a> already exists for this purpose &#8211; making an additional E-ID redundant. Second, it is intended for age verification in everyday life, such as at supermarkets or kiosks. But here too, the physical identity card is entirely sufficient. In fact, it is the better solution, because it leaves no digital traces and protects privacy more effectively. In short: conventional IDs are clearly superior to the E-ID in terms of both security and data protection.</p><h2><strong>Referendum Campaign in the Final Sprint</strong></h2><p>The campaign for the upcoming vote is entering its final phase. I have laid out in detail why the Swiss E-ID law is dangerous, unnecessary, and should be rejected. Many more arguments could be made, but this would go beyond the scope. The civil rights movement <em>MASS-VOLL!</em>, of which I am a member, launched the referendum in January. With the signatures it collected, it played a decisive role in ensuring that the Swiss people can vote on this proposal on September 28.
